I believe that you can either settle the case or get a clear picture of everyone's true position if
you can have a check available at the mediation. If you push a check across the table and tell her
she can walk out with the money, she will probably take it. will
not want her to in all
probability, but it lets him off the hook if she demands it. If Critton does not know about it until
the last minute, he cannot screw it up on purpose. Better yet, have 2 checks; one with her name
and one to Brad's law practice. Offer the one with her name on it first. When they go
apoplectic, show the other one and say they can have either check. Brad does not want it to be
in her name becaue then he has to take $ away from her rather than make her sign a settlement
agreement with him for her to get her amount. What the hell do you care? If it creates the same
working environment between
and her that exists for you and Critton, so much the
better, especially if it does not settle. This girl is a concrete thinker. Until she sees the money, it
is not real, but once she does... Also, if it does not settle, she will think about the fact she gave
up money in front of her and this increases the chance she will cave before trial. I think the
reason Critton discourages it is because it might work.
