As you may recall, after her second bail application had been denied by Judge Nathan, she filed a notice of appeal to the Second Circuit. She has not yet filed any briefing. We are planning to oppose the third bail application, but wanted to check in with you about whether there are any arguments we should raise in our opposition in light of her pending appeal. (I know I had emailed you about an appeal divesting the district court from jurisdiction in a different context last week, but we wanted to raise this since it is a fuzzy area that depends on the order being appealed).
