Preliminary investigation revealed a series of protocol failures by MCC personnel, as well as technical failures/deficiencies within the MCC at the time Epstein was discovered. During the course of the investigation, no criminality was found pertaining to the death of Epstein. Further investigation resulted in the charging of two correctional officers at the Metropolitan Correctional Center with Title 18, United States Code, Sections 1001(a)(3) and 2 (False Records) and Title 18, United States Code, section 371 (Conspiracy). On 5/2021, the United States Attorney's Office for the Southern District of New York entered into a deferred prosecution agreement with the two correctional officers, Tova Noel and Michael Thomas, for a period of six months. Case Developments On 8/12/2019, FBI NYFO opened a 90A, Irregularities in Federal Penal Institution - Crime of Violence, investigation into the death or Epstein. • FBI NY interviewed 23 individuals during the investigation. • FBI NY's case file consisted of 207 serials. • 60 items of evidence were recovered during the investigation, to include: o 1 Piece of fabric utilized by Epstein as a "hand made noose". o MCC's entire DVR system. o Cell Phone belonging to MCC Correctional Officer Thomas. The Office of the Chief Medical Examiner of the City of New York (OCME) provided a finalized autopsy report, Case No. M-19- 019432. According to the OCME autopsy report, the cause of death of Epstein was hanging and the manner of death was suicide. After the case was closed, evidence items were transferred to the custody of OIG. Timeline On 7/6/2019, Epstein is arrested. On 7/8/2019, Epstein is held at MCCs in a private cell for 24 hours for Psychological Evaluation and observation. On 7/9/2019, Epstein is placed in a cell with On 7/23/2019, Epstein attempts suicide. On 7/24/2019 through 7/29/2019, Epstein is placed in a private cell, on suicide watch, by MCC. On 7/29/2019, MCC Chief Psychologist approves Epstein to be removed from suicide watch. Epstein is placed into MCC cell with Efrain Reyes. On 8/9/2019, Reyes is discharged and released from MCC. On 8/10/2019, Epstein commits suicide. Background

Background Jeffrey Epstein was formally charged with Sex Trafficking Conspiracy in violation of 18 U.S.C. Section 371 and Sex Trafficking in violation of 18 U.S.0 Section 1591(a), (b) (2), 2 on July 2, 2019. Specifically, he was accused of sexually exploiting and abusing minor females over the course of several years. Charging documents allege that Epstein enticed and recruited minor females to engage in sexual activity. The minor females were reportedly compensated with case following the sexual encounters and some were encouraged to find other minor females to accompany them to Epstein's residences in New York and Florida. Visit of United States Attorney's Office for the Southern District of New York October 10, 2019 MCC-Epstein Investigation will present on their investigation into the events at the Metropolitan Correctional Center on August 9-10, 2019, the night that Jeffrey Epstein committed suicide. In the last two months, our Office, along with agents from the FBI and DOJ-OIG, have interviewed more than 40 witnesses, including 27 MCC employees and 16 inmates at MCC; reviewed records from the MCC as well as financial records for the relevant employees; conducted searches of the cellphones used by certain of the relevant prison guards, and reviewed dozens of hours of the limited videotape evidence the FBI has thus far been able to recover in the face of technical data recovery issues.
