By way of background, our Office agreed to not prosecute Epstein for having sex with minors in exchange for his guilty plea to state charges involving soliciting underage prostitutes. Epstein recently completed the incarceration component of his sentence and is now a registered sex offender. The npa required Epstein to compensate, pursuant to 18 USC 2255, approximately 40 identified girls who he victimized. 2255 established a set amount of damages - either $150,000 or $250,000 - for victims of anyone convicted of a federal offense involving sex with minors. Epstein agreed not to contest liability involving these girls so long as they proceeded under 2255. So for example, if they decided to sue Epstein using other civil liability theories, Epstein would not have to pay their reasonable attorneys' fees. If, on the other hand, they agreed to accept compensation pursuant to 2255, Epstein agreed to pay their attorney's fees. Bob Josefsberg vis-à-vis the Podhurst firm is the lawyer who represents many of these girls. The attached complaint sues Epstein for his failure to pay Josefsberg/Podhurst reasonable attorney's fees.
