I know this is important to you so I wanted you to know we were looking at it and would respond quickly. Here's our position, please would you quote it in both of your papers: We object to the Court considering the motion for a stay and the motion to dismiss without also considering the merits of the appeal. We filed our merits brief early, two weeks before it was due, to facilitate the court's consideration of the substantive issues in an expedited basis.
