I asked what they were. He said they are back to doing the state-charges-only agreement, which he said should be worked out by the middle of next week. I said we need a signed agreement by tomorrow or we are indicting on Tuesday. He then tried a bait and switch — "Alex promised us 2 weeks after our meeting, which would be September 28th." I reminded him that the meeting was on September 7th, so 2 weeks ends tomorrow, and that you and I talked about how that time period would still allow me to keep my target indictment date of the 25th. There was some hemming and hawing and then a promise to call me tomorrow morning to talk through any outstanding issues with the Non-prosecution agreement that we sent to them last week.
