I also sent her the copy of the NM letter stating that you are not required to register under NM law. I did not send Erika the original submission Jay sent to the DA in connection with the Level hearing as I was not sure that you wanted to provide Erika with info at such a granular level. That is to say, I was not sure that you want Erika to have the letter to the DA whiclifor exam le, indicates that claimed to be 14 when she first met you, references penetration ofM, and sex with . On the other hand, the letter was submitted to the DA and resulted in the DA agreeing to a lower designation. The appellate briefs that I sent to Erika recite the fact that the DA agreed to the lower designation, so not sure that Erika needs this level of detail. Your call. I also did not send Erika the DA's Appellate Brief as the DA's brief contains numerous detailed allegations of a sexual nature from Recarey's affidavit. Obviously, the DA's brief is not helpful, but at the same time, do you want Erika to be familiar with it in case the RT Board gets or already has a copy of it from the appellate division's file.
