The apartment lease and stock is in Noam's sole name; 2. There is no consent required to transfer it to Valeria or into joint names. I recommend a transfer into joint names in order to minimize the gift tax consequences as Valeria is not a US citizen; 3. Before you place the home on the market certain notice provisions must be adhered to. I recommend that you work with the head of our real estate practice group, Michael Rosen, on this sale to ensure that all requirements are correctly approached, documented and negotiated.
