Ms died on March 17th, 1992, four days after the incident on the Lower Kilmacud oa The car's driver, Mr Brian Kennedy, told last week's inquest into Ms death he left the scene because he panicked. He then went home and drank vodka, before being driven to the Garda station by a friend. Mr Kennedy was convicted of dangerous driving arising out of the incident and jailed for three months. He was also fined £300 for driving without insurance and £200 for the unlawful use of the car, which belonged to his mother. He was released having served two weeks of his sentence. Mr Leo told The Irish Times that he was pleased with the inquest verdict as he believed it left the way open for a civil case against Mr Kennedy. "As far as we're aware, it's a landmark verdict. The coroner gave them three options but the jury added a rider which to us was a very important one." The jury found that M died from severe cerebral injuries secondary to trauma, and that this was due to e impact of a motor vehicle. Mr says he is determined to see the case through, despite both the financial and psychological costs of such a course. "It would probably be better for me to get Brian Kennedy out of my head. But at the same time, being in the MAAD organisation (Mothers Against Drunk Driving) I know that to get anything changed we have to take this case. My antagonism is not towards Brian Kennedy, it's towards the system. It's not a vengeance thing for us. Obviously it's going to be very expensive, we'd have to fund it ourselves and there's no guarantee we'd win." Mr relieves the State should introduce charges such as negligence of the highest order or in severe cases vehicular manslaughter. For internal use only CONFIDENTIAL - PURSUANT TO FED. R. CRIM.
